Technically as a non-resident alien you would not be eligible to claim the EITC.

A non-resident alien could be a resident alien for tax purposes if given conditions are met.

What’s your visa status? If it’s one time just keep under the rug and move on. IRS can not share anything to USCIS. USCIS folks won’t nitpick as long you have filed TAX. Just chill

Aliens.
In general:
F and J student visa holders are considered resident aliens after five calendar years in the U.S.
J researchers and professors are considered resident aliens after two calendar years in the U.S.
H-1, TN, and O-1 visa holders are considered resident aliens once they meet the “substantial presence” tes
